1. Acceptance of Terms

By accessing or using this website, https://www.thevillagemd.com/ (the “Site”), booking a class or service, submitting forms, or communicating with The Village through any associated platform, you agree to be legally bound by these Terms & Conditions and our Privacy Policy.
 

If you do not agree, do not use the Site or any related services.
 

These Terms apply to all users, including visitors, clients, class participants, practitioners, providers, and any individual who books, submits information, or communicates through the Site or associated platforms.

2. No Medical, Mental Health, or Professional Advice

All content, information, and services referenced on the Site or communicated through associated platforms are provided for general informational, educational, and administrative purposes only.

Nothing provided by The Village constitutes or should be construed as:

• medical advice

• mental health advice

• diagnosis

• treatment

• therapy

• professional healthcare services
   

The Village does not provide medical or mental health services.
 

All services offered at or through The Village are provided by independent practitioners, not by The Village itself. You assume full responsibility for any decisions made based on information obtained through the Site or communications.

3. Independent Practitioners

All practitioners operating at or through The Village are independent contractors.
 

The Village:

• does not supervise clinical services

• does not control practitioner conduct

• is not responsible for practitioner advice, actions, omissions, outcomes, or services
   

Any disputes, claims, or concerns regarding services must be addressed directly with the practitioner.

4. Bookings, Payments, and Third-Party Platforms

Bookings and payments may be processed through third-party platforms, including Bookeo.
 

You acknowledge and agree that:

• The Village does not control third-party platforms

• The Village is not responsible for outages, errors, failed transactions, duplicate charges, cancellations, data breaches, or security issues

• All payment disputes must be resolved directly with the relevant payment processor or platform
   

5. Forms, Submissions, and User Responsibility

We may collect information through:

• Bookeo

• ClickUp forms

• Google Forms

• email communications
   

Submission of information is voluntary. You are responsible for ensuring that information provided is accurate and appropriate.
 

You agree not to submit sensitive medical or health information through the Site or forms unless expressly requested by a licensed provider acting independently.
 

6. Email Communications & Data Synchronisation

By booking a class, submitting a form, or providing your email address, you consent to receive:

• transactional emails (confirmations, reminders, updates)

• administrative communications

• marketing emails where permitted by law
   

Email communications are managed through Flodesk.

Data Transfer Disclosure

Information submitted through Bookeo (including name, email address, and booking details) may be transferred to Flodesk for the purposes of:

• booking confirmations and reminders

• service-related communications

• marketing or promotional communications where permitted by law
   

You may unsubscribe from marketing emails at any time. Transactional and service-related emails may continue regardless of marketing preferences.

7. Use of Site

You agree to use the Site only for lawful purposes. You may not:

• misuse or interfere with Site functionality

• attempt unauthorized access

• use the Site to harass, threaten, defraud, or harm others
   

The Village reserves the right to restrict or terminate access at any time without notice.
 

8. Intellectual Property

All content on the Site, including text, graphics, images, branding, and logos, is owned by or licensed to The Village and protected by US and international intellectual property laws.
 

No content may be copied, reproduced, distributed, or exploited without prior written permission.
 

9. No Warranties

The Site and all content are provided “AS IS” and “AS AVAILABLE.”

The Village makes no warranties regarding accuracy, completeness, reliability, availability, or fitness for any purpose.

10. Limitation of Liability

To the maximum extent permitted by law, The Village shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

• use of the Site

• bookings or payments

• form submissions

• email communications

• reliance on information

• practitioner services

• third-party platforms
   

This applies even if The Village has been advised of the possibility of such damages.
 

11. Maximum Damages Cap

In no event shall The Village’s total liability exceed USD $100, regardless of the nature or number of claims.
 

12. Indemnification

You agree to defend, indemnify, and hold harmless The Village, its owners, directors, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney’s fees) arising from:

• your use of the Site

• your submissions or communications

• your interactions with practitioners

• your violation of these Terms
   

13. Statute of Limitations

Any claim or cause of action must be filed within one (1) year of the event giving rise to the claim, or it is permanently barred.

14. Governing Law & Venue

These Terms shall be governed exclusively by the laws of the State of Maryland, without regard to conflict-of-law principles.
 

All legal actions must be brought exclusively in state or federal courts located in Maryland.
 

15. Class Action Waiver

You agree that any dispute shall be brought only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative action.

16. Changes to Terms

The Village reserves the right to modify these Terms at any time. Continued use of the Site constitutes acceptance of any changes.
